3.3 - Negotiation

When reviewing awards, SPA and the PI/PD should pay particular attention to language regarding:

  • restrictions on publications;
  • access by foreign nationals;
  • intellectual property rights;
  • indemnification;
  • frequency of reports.

As a public, comprehensive, research institution whose primary functions are the creation, dissemination, and application of knowledge, the university must protect the right to disseminate research results in publications; protect intellectual property and data rights; protect itself and the PI/PD from liability; and generate revenue without burdensome systems requirements. If there is language in the award that precludes any of these items, then SPA will try to negotiate with the sponsor to have the language removed from the award.
